Products Liability Cases
Manufacturers of consumer goods are legally obligated to make sure that their products are free from any design or manufacturing defects that could cause injury or harm to a consumer, such as defective tires and toys made with lead paint.
Product liability cases can be filed on the grounds of negligence, strict liability, or breach of warranty. The Louisiana Products Liability Act (LPLA) allows injured persons to obtain remedies from a manufacturer when a product is deemed “dangerous” because of a design defect, a manufacture defect, a failure to warn of a danger, or a failure to uphold a warranty’s claims.
An injured person may also be able to sue for recovery if the product was not defective and he or she was still injured while using it as designated or instructed. Depending on the specifics of your case, damages may also be sought against a product’s distributor or retailer.
The term “products” in products liability refers to any type of consumer good, including:

Unless you are under 18 years of age, the statute of limitations for filing a defective products liability case in Louisiana is one year from the date of the injury accident.
